Explainer Highlights Legal Basis of Wontumi’s Samreboi Conviction

Following the conviction of NPP Ashanti Regional Chairman Bernard Antwi-Boasiako, popularly known as Chairman Wontumi, MyJoyOnline has published an explainer outlining the legal charges and evidence that formed the basis of the High Court's decision.

The report details the six charges brought against Mr Antwi-Boasiako, Akonta Mining Company Limited and a co-accused, Kwame Antwi, under the Minerals and Mining Act, 2006 (Act 703), as amended.

According to the charge sheet, the accused were prosecuted for assigning mineral rights without the required ministerial approval and for facilitating unlicensed mining operations on the Samreboi concession in the Western Region.

The explainer also recounts the April 2025 police operation that resulted in the arrest of several suspects and the seizure of excavators, firearms, vehicles, suspected gold materials and GH¢157,000 in cash.

During the trial, prosecutors argued that Mr Antwi-Boasiako authorised mining activities on the concession, while the defence maintained that the land was intended for reclamation and a coconut plantation project rather than mining.

The Republic has applied for the forfeiture of all items recovered during the operation, with the court expected to determine the application alongside sentencing.

Commentary | Boakye Stephen:

Although not a separate court proceeding, the explainer provides readers with a comprehensive understanding of the legal provisions, evidence and arguments that culminated in Chairman Wontumi’s conviction, offering important context to one of Ghana’s most closely watched illegal mining cases.
